Terms & Conditions
Application
1. The following Terms & Conditions (hereafter, “terms”) apply to all offers, contracts and other agreements between Evelyn M Interiors and the client.
1.1 The Terms & Conditions of the client are not applicable.
2. Proposal
2.1 A written proposal for the project is created free of charge following a non-refundable, paid-for consultation with Evelyn M Interiors.
2.2 The proposal will include a description of the project, the results and the design process.
2.3 A proposal from Evelyn M Interiors is valid for 2 weeks (10 working days) after the date it was created.
2.4 Following the consultation, you are under no obligation to use Evelyn M Interiors. However, 50% of your consultation fee will be deducted from the total design fee if you do.
3. Contract
3.1 The contract refers to the description of the project in the proposal.
3.2 If the contract, scope or desired result of the project changes during the design process, an additional agreement will need to be made, or the project will be terminated (see 7. Early Termination) and a new contract will be proposed.
4. Project Execution
4.1 In the case of the client wanting to make significant changes to the design in a way that doesn’t align with the original creative brief, the cost of these changes will be charged.
4.2 The client agrees to provide feedback on all creative work within a reasonable time frame (5 working days).
4.3 If a client deliverable, such as input, approvals, or payment is late by more than 10 working days, the project will be considered ‘on hold’. Once the deliverable is received, the project will be re-scheduled, based on Evelyn M Interiors’ current workload and availability.
4.4 In the case of something being incorrect, or missing compared to what was agreed in the project contract, the client has 2 weeks (10 working days) after the design is finished to let Evelyn M Interiors know, in writing.
4.5 If the client reports this later than 2 weeks (10 working days), the costs of any additional changes will be charged to the client.
5. Intellectual Property
5.1 Evelyn M Interiors is the holder of all intellectual property rights for works created - including copyright.
6. Payment & Advice
6.1 Invoices sent by Evelyn M Interiors will need to be paid within 10 working days.
6.2 If payment is not received within 10 working days, additional administration costs may be charged.
6.3 To confirm acceptance of the design proposal, the client pays a non-refundable deposit, as described in the design proposal.
6.4 The remainder of the design fee will be invoiced in pre-agreed stages as the design work is completed.
6.5 Payment for materials, furniture, or other items relating to the design schemes will be invoiced prior to orders being placed. No orders will be placed before payment for such items is received.
6.6 The final designs will be delivered once the final payment has been received.
6.7 Any work that extends beyond the original brief will be charged at an hourly rate.
6.8 Evelyn M Interiors reserves the right to change her hourly rate at any time.
7. Early Termination
7.1 In the case of the project being terminated by the client before completion, the client will pay 75% of the total fee, to compensate for the design work already completed.
8. Photography
8.1 At the end of the project, Evelyn M Interiors will book a suitable day to take photographs of your finished space for use in their portfolio.
8.2 Evelyn M Interiors has full rights to use all project photographs for advertising their work. This includes, but is not limited to use on social media, websites, blog posts and magazine articles.
9. Liability
9.1 Evelyn M Interiors is not liable for errors or mistakes in the materials or information supplied by the client, or third parties.
9.2 Evelyn M Interiors is also not liable for any damages that result from use of the design.
9.3 Any liability of Evelyn M Interiors is limited to the total fee that is invoiced for the project concerned.
10. Disputes
10.1 English law is applicable to all agreements made between Evelyn M Interiors and the client.
10.2 In case of any disputes between Evelyn M Interiors and the client, the court of England has exclusive competence.
